Terms of Service for The Meticulous Archivist

Dave’s mission as your Meticulous Archivist is to provide a high-trust, professional service for preserving your most precious memories. These Terms of Service are designed to establish clear expectations and protect both you and us, ensuring a secure and transparent process from start to finish. By using our services, you agree to these Terms.

1. Our Services & Scope of Work

We provide professional video and photo digitization services as outlined in our service pages and a formal quote. Because every project is unique, ranging from a single tape to multiple boxes of mixed media, the specific scope of work for your project will be defined in a detailed, itemized quote provided to you after our initial consultation.

Our standard digitization service includes:

  • Professional capture of your media using our high-quality equipment.
  • Logical file naming and organization.
  • Delivery of a standard digital file (e.g., MP4, JPG).

Any additional services, such as media editing, colour correction, or advanced restoration, are considered separate and will be clearly itemized in your project quote.

2. Pricing & Payments

Your final price is based on the formal quote provided to you. Our pricing is transparent and based on a per-item or per-package rate.

For projects with a total value of over $100, a non-refundable deposit of 50% of the quoted amount is required to begin work. The remaining balance is due upon project completion.

We will send a digital invoice via Wave, payable online via Stripe. All project files will be delivered to you only after the final payment has been successfully processed.

3. Project Timelines

We provide an estimated timeline for the completion of your project during our initial consultation. This timeline is a good-faith estimate and may be affected by the condition of the original media, the volume of the materials, or other unforeseen technical issues. We will communicate any significant delays with you in a timely and transparent manner.

4. Limitation of Liability

We understand the irreplaceable nature of the media you entrust to us. We handle every item with the utmost care and professional diligence. However, in the unlikely event of loss or damage to your original media while in our possession, our liability will be strictly limited to the cost of the services provided for that media. We will not be liable for the sentimental or inherent value of the content contained on the media.

5. Client Responsibilities

To ensure a smooth and efficient process, the client is responsible for:

  • Delivering all media to us in person at our designated location.
  • Promptly responding to communications regarding your project.
  • Reviewing and approving any watermarked samples provided to you.
  • Picking up your original media promptly after the digital files have been delivered.

6. Copyright & Content Ownership

By providing us with your media, you confirm that you are the legal owner of the content or have the full legal right and permission to have the content digitized. You retain all copyright and ownership of the content. You grant The Meticulous Archivist a limited, temporary license to create digital copies of your media solely for the purpose of fulfilling your project.

7. Governing Law

This agreement is governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of British Columbia.
